GENERAL TERMS AND CONDITIONS OF SALE – JK FISHER

The website jkfisher.fr (the "Site") is operated by JK FISHER, 16 Allée Van Gogh, 33160 Saint-Aubin-de-Médoc, France – SIRET 930 810 155 00018 (the "Seller").

These General Terms and Conditions of Sale (GTC) govern the sale of products from the Site to consumers within the meaning of the French Consumer Code. Any order implies full and unreserved acceptance of these GTC.
1. Purpose and scope of application
The GTC define the rights and obligations of the parties in connection with the online sale of products offered by JK FISHER.
They prevail over any other document, unless otherwise agreed in writing.
The Customer declares to have the legal capacity to contract.
2. Products
The essential characteristics of the products are presented on the Site. Photos and visuals are not contractually binding. Offers are valid while stocks last. In the event of unavailability after ordering, the Customer will be informed and reimbursed without undue delay, unless an agreement for replacement or credit is reached.
3. Prices
Prices are indicated in euros, all taxes included (TTC). Delivery costs, customs duties or any local taxes remain the responsibility of the Customer.
JK FISHER reserves the right to modify its prices at any time, the applicable price being that in force at the time of the order.
Any obvious pricing error will result in the cancellation of the order and full refund.
4. Order
The Customer selects the products, adds them to their basket, checks the details of their order and validates their payment.
Validation of the order implies acceptance of these GTC and the obligation to pay.
JK FISHER reserves the right to refuse or cancel any order in case of suspected fraud, payment incident or previous dispute.
The data recorded by the Site and the payment provider constitute proof of transactions.
5. Payment
Payment is due immediately upon order.
Accepted means: [to be completed: credit card, PayPal, Shopify Payments, etc.].
Payments are secured by an approved provider. JK FISHER does not store the Customer's bank details.
In the event of an incident or presumed fraud, the order may be suspended or cancelled.
6. Retention of title
The products remain the property of JK FISHER until full payment of the price.
Risks are transferred to the Customer upon actual delivery of the package to them or to the carrier designated by them.
7. Delivery
Products are delivered to the address indicated during the order. Delivery times are indicative and may vary depending on the carrier, period and location.
In the event of a significant delay, the Customer may request the cancellation of the sale in accordance with article L.216-2 of the Consumer Code.
The Customer must check the condition of the package upon receipt and report any anomaly to the carrier within 48 hours and to contact@jkfisher.fr without delay.
8. Right of withdrawal
In accordance with articles L.221-18 and following of the Consumer Code, the Customer has 14 calendar days from receipt of their order to exercise their right of withdrawal, without justification.
To exercise this right, the Customer must send an e-mail to contact@jkfisher.fr stating their first name, last name, order number and relevant item.
Products must be returned within 14 days of this notification, new, unused and in their original intact packaging, to:

Return costs are the responsibility of the Customer unless JK FISHER is at fault.
Reimbursement is made to the original payment method within 5 to 10 working days after receipt and inspection.
No withdrawal is possible for personalized or custom-made products, discounted or promotional items, and goods unsealed for hygiene reasons.
9. Returns and after-sales service
Any return must be subject to a prior request to contact@jkfisher.fr
The email must include a clear subject (e.g. After-sales service, order not received, delivery problem, etc.), the order number, as well as the Customer's first and last names.
Products must be new, complete and in their original packaging.
Non-compliant returns may be refused and returned to the Customer at their expense.
10. Legal guarantees
Products benefit from legal guarantees of conformity (articles L.217-3 to L.217-20 of the Consumer Code) and against hidden defects (articles 1641 to 1649 of the Civil Code).
For any request, the Customer must contact contact@jkfisher.fr with proof of purchase, photos and a description of the defect.
11. Liability
JK FISHER cannot be held liable for indirect damages or damages resulting from improper use of the product.
No clause limits the mandatory rights of the consumer or liability in case of fraud, gross negligence or bodily injury.
12. Force majeure
JK FISHER cannot be held responsible in case of a force majeure event as defined by article 1218 of the Civil Code (strike, network failure, natural disaster, etc.).
Obligations are suspended for the duration of the event.
13. Intellectual property
All elements of the Site (texts, images, logos, etc.) are protected by copyright and intellectual property.
Any total or partial reproduction without written authorization is strictly prohibited.
14. Personal data
The processing of personal data is governed by the Privacy Policy available on the Site.
The Customer will find all information regarding the collection, use, storage and protection of their data there.
15. Promotional codes, gift cards and programs
Promotional codes cannot be combined, are time-limited and subject to conditions (minimum basket, exclusions, etc.).
Gift cards and credits are valid for 12 months from their issue date, are non-refundable and non-convertible into cash.
16. Mediation and dispute resolution
In case of dispute, the Customer must first contact customer service at contact@jkfisher.fr to attempt an amicable resolution.
If no agreement is reached, the Customer may have free recourse to a consumer mediator.
17. Governing Law
These GTC are governed by French law.
In case of dispute, French courts will have sole jurisdiction, without prejudice to the consumer's right to refer the matter to the court of their place of residence.
